MORTGAGE FORECLOSURE NOTICE
Default having been made in the terms of that mortgage executed on the 16th day of September, 2022, by MICHAEL CHARLES HALEY and KRISTY CURRY, married, as mortgagor in favor of State Bank and Trust, as mortgagee, which said mortgage is recorded in the Office of the Judge of Probate, Fayette County, Alabama, in OFFR Book 2022 at Page 3543 and State Bank and Trust, as mortgagee, having declared all of the indebtedness secured by said mortgage due and payable and such default continuing, notice is hereby given, that acting under and by virtue of the power of sale contained in said mortgage, State Bank & Trust, as mortgagee, will sell at public outcry, for cash, to the highest bidder, in front of the Main door of the Courthouse in Fayette, Fayette County, Alabama, during the legal hours of sale, on MARCH 23, 2026, the following described real estate, together with hereditaments and appurtenances there unto belonging and all fixtures now attached to and used in connection with the premises herein described, to-wit:
A tract of land being in the Southeast part of the SW ¼ of SW ¼, Section 2 , Township 16 South, Range 13 West and in Fayette County, Alabama. Beginning on the East line of said forty and on the South right-of-way of the Fayette-Covin Highway and running in a westerly direction along said right-of-way for a distance of 355 feet to a field road; thence in a Southeasterly direction to an iron stake on the Old Fayette-Columbus Road; thence in a Northeasterly direction along the Old Fayette-Columbus Road for a distance of 137 feet to the East line of said SW ¼ of SW ¼; Thence North along said SW ¼ of SW ¼ line to the Fayette-Covin Highway right-of-way line and point of beginning .
LESS AND EXCEPT: A tract of land located in the SE part of the SW ¼ of SW ¼, Section 2, Township 16, Range 13 West, lying north of the Old Fayette-Columbus Road, more fully described as follows: Begin at a point where the east line of said forty is intersected by the south edge of the right-of-way of Highway #96, run 355 feet westerly along said right-of-way to the field road, which is a driveway, run 155 feet southeasterly along said drive to an iron stake, the point of beginning, run further southeasterly along grantees east line to an iron stake on the north edge of the Old Fayette-Columbus Road, run 137 feet northeasterly along said road to the east line, run north along said east line to an iron stake standing 97 feet south of the South edge of the right of way of Highway #96, run Southwesterly in a straight line to the point of beginning.
The property herein conveyed is also described by the survey of Heath Reed, Alabama Registered Surveyor, PLS 32622-S, dated October 3, 2021, the surveyed description being set out in this deed in aid of this conveyance, in addition to the aforesaid description and not for the purpose of limiting the aforesaid description, but for the purpose of aiding and clarifying said description and is described by the aforesaid survey as follows:
Said parcel being in and a part of the SW ¼ of SW ¼, Section 2, Township 16 South, Range 13 West, Fayette County, Alabama, and being more particularly described as follows: Beginning at the intersection of the east line of the SW ¼ of SW ¼, Section 2, Township 16 South, Range 13 West, Fayette County, Alabama with the south right-of-way of Alabama Highway 96 (80-foot right-of-way indicated) and a 5/8” rebar, thence run westerly along said south right-of-way around a curve to the right having a radius of 2383.10 feet and a chord bearing of S 89° 59’ 44” W for an arc distance of 356.13 feet to the east edge of a driveway and ½” capped rebar; thence run southerly along the east edge of said driveway tor a distance of 155.19 feet to a ½” capped rebar; thence run N 80° 26’ 07” E for a distance of 326.18 feet to a ½” capped rebar; thence run N 00° 12’ 55” W for a distance of 96.94 feet to the point of beginning.
Said property will be sold on an “as is, where is” basis subject to any easements, encumbrances, and exceptions contained in said mortgage and those contained in the records of the Office of the Judge of Probate where the above-described property is situated. Said property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto. This sale is made for the purpose of paying the mortgage debt, cost and expense of foreclosure.
