NOTICE OF MORTGAGE FORECLOSURE SALE
Default having been made under the terms of that certain mortgage executed by Brian Sean Peoples, a married man, on the 1st day of May, 2018 to West Alabama Bank & Trust which said mortgage is recorded in the Probate Office of Fayette County, Alabama, in Mortgage Book 2018, at Page 1286, and by reason of such default, having declared all of the indebtedness secured by said mortgage due and payable, and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage, West Alabama Bank & Trust will sell at public outcry, for cash, to the highest bidder, before the main entrance of the Courthouse in the City of Fayette, Fayette County, Alabama, at noon or otherwise during the legal hours of sale on May 11, 2026 the following described real estate situated in Fayette County, Alabama, to-wit:
24.79 acres of land located in the NW¼ of NW¼; Section 19, Township 16, Range 17 West, more particularly described as follows: Begin at the NW corner of NW¼ of NW¼ (the same being the section corner of said section); go thence South along the West boundary line of the said forty a distance of 927 feet to an iron stake located at the NW corner of Lot No. 31 of the Thomas H. Cannon Subdivision: go thence in a Southernly direction along the North boundary line of the said Lot No. 31 (now owned by Ed Savage) a distance of 975 feet to the West right of way line of Fayette-Newtonville State Highway (now Alabama State Highway 171) to a stake; go thence Northeasterly along the said West right of way line of said highway a distance of 1196.1 feet to an iron stake marking the North boundary line of the forty; go thence West along the said North boundary line of said forty a distance of 1170.44 feet to the point of beginning.
LESS AND EXCEPT: A parcel of land located in the NW¼ of the NW¼ of Section 19, Township 16 South, Range 12 West of Fayette County, Alabama, and containing 4.17 acres, more or less, and being described as follows: Begin at NW corner of Section 19, Township 16 South, Range 12 West; thence go Northerly along the West line of said SW ¼ of the SW ¼. Section 18, Township 16 South, Range 12 West for a distance of 210.00 feet to an iron pipe; thence turn an angle to the left from a backsite of 45°38’33” and go a distance of 768.30 feet to the point of beginning; thence turn an angle to the left of 141°00’20” from a backsite and go a distance of 141.80 feet to a point; thence turn an angle to the right from a banksite of 169°17’12” and go a distance of 288.21 feet to a point; thence turn an angle to the right from backsite of 104°57’29” and go a distance of 109.56 feet to a point; thence turn an angle to the right from a backsite of 92°38’24” and go a distance of 127.70 feet to a point; thence turn an angle to the right from a backsite of 276°29’16” and go a distance of 282.08 feet to a point on the West right of way of Alabama Highway No. 171; thence turn an angle to the right of 87°10’28” and go along the chord of curve for a distance of 300.68 feet to a point; thence turn an angle to the right from a backsite on chord of 186°00’00” and go a distance of 100.00 feet along the chord of curve to a point; thence turn an angle to the right from a backsite on chord of curve of 72°33’57” and go a distance of 438.32 feet to a point; thence turn an angle to the right from a backsite of 173°14’57” and go a distance of 98.69 feet to the point of beginning.
ALSO: 5.90 acres of land located in the SW ¼ of SW ¼, Section 18, Township 16, Range 12 West, being further described as follows: Begin at SW corner of Section 18 and run North 87°30’ East along South line of said section a distance of 1170.44 feet to a point on the West right of way line of the Fayette-Newtonville State Highway (now Alabama State Highway 171); then deflect an angle clockwise from backsight of 116°40’ and run along the West right of way line said highway a distance of 235 feet; then deflect an angle clockwise of 63°20’ and run a distance of 1277 feet to a point on the West line of said Section 18; then deflect an angle clockwise of 87° and run a distance of 210 feet to the point of beginning; thence deflect an angle clockwise of 93° closing the traverse.
Subject to ad valorem taxes for the current year and existing easements, restrictions, set-back line, right of way, and/or limitations, if any, or record.
Together with the hereditaments and appurtenances thereunto belonging and all fixtures now attached to and used in connection with the premises herein described.
Said sale will be subject to the right of way easements and restrictions of record in the Probate Office of Fayette County, Alabama, and will be subject to outstanding property taxes, and existing special assessments, if any, which might adversely affect the title to subject property.
Said property will be sold on an “As Is, Where Is” basis without warranty or recourse, express or implied as to title, use and/or enjoyment. Neither the mortgagee, nor the officers, directors, attorneys, employees, agents or authorized representative of the mortgagee make any representation or warranty relating to the title or any physical, environmental, health or safety conditions existing in, on, at or relating to the property offered for sale. Any and all responsibilities or liabilities arising out of or in any way relating to any such condition, including those suggested by Code of Ala. (1975) §35-4-271, are expressly disclaimed.
Said sale will be made for the purpose of paying the indebtedness secured by the above described mortgage, and the proceeds thereof will be applied as provided by the terms of said mortgage. The successful bidder must tender a non-refundable deposit in certified funds made payable to Reynolds, Reynolds & Little, LLC at the time and place of the sale. The balance of the purchase price must be paid in certified funds or by wire transfer by 5:00 p.m. the next business day at the Law Office of Reynolds, Reynolds & Little, LLC at the address indicated below unless prior to said sale Reynolds, Reynolds & Little, LLC has agreed to a later date or closing location. The Mortgagee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.
The failure of any high bidder to pay the purchase price and close this sale shall, at the option of Mortgagee, be cause for rejection of the bid, and if the bid is rejected, Mortgagee shall have the option of making the sale to the next highest bidder who is able, capable and willing to comply with the terms thereof.
This sale is subject to postponement or cancellation.
